Terms

Please read the following travel conditions that govern the contractual relationship between you and us and which you recognize with your booking. They meet the legal requirements of the travel contract law (§§ 651 a ff. BGB ).

Registration, Travel Confirmation and Payment:
The registration has to be done in a written form, acknowledging the travel conditions. If you book for more people, you shall be liable for them if you excepted an additional bond, as for your own obligations. The contract is valid through our written confirmation that we send within 7 working days. Deviates our travel confirmation of the contents from your booking, this is a new offer to you, we are bound to that new offer for seven days from receipt of the confirmation. Within this period you can accept it, expressly or by payment of the price. Our services result from the findings to the respective destinations in the catalog, its general instructions and data from the confirmation. Side letters (special requests, special arrangements), the scope of change require our confirmation. Upon receipt of the confirmation each person has to deposit 20% (maximum 250€) of the full price. Regarding § 651 k BGB the customer recieves with the booking confirmation a chattel paper to secure the price of the travel. We point out that in case of a non-payment of the deposit, Simsalabim Reisen is allowed to withdrawal from the contract, but is not commited to do so.

As far as the payment is not intended at any specific time of the calendar, default occurs under the statutory provisions, automatically within 30 days after the due date and receipt of the invoice. The travel documents or receipt of payment will be sent or delivered.

Cancellation and rebooking by the participants:
In case of a withdraw from the trip, we strongly recommend that you take a travel cancellation insurance. You can always withdraw before departure from the trip, to avoid confusion, we explain the resignation request in writing. In case of cancellation the following cancellation liquidated shall help:

Up to 30 days before the travel 20 %, 29 - 15 days before the travel 40 %, 14 - 7 days before the travel 60 %, 6 -1 days before the travel 80 %, unannounced no-show 90 % of the price of the travel.

It is up to you to demonstrate us that the damage in your individual case is lower than these percentages. In case of a non-commencement of the customer,  the contract remains valid. In this case the participants pays the full cost of the tour price. If you bring a substituting person instead of you - only a handling fee of 10 € has to be paid. Subsequent changes are possible only in the form of a resignation on the above cancellation conditions, followed by registration.

Cancellation by SimSalaBim Reisen:
In some trips, we have established minimum numbers of participants, is no number specified, the minimum number of participants per trip is 8 people. If this group can not be achieved, we are entitled to cancel the tour. In this case payments already made will be refunded. Our cancellation later than 1 week before departure is not allowed. The organizer has the right to cancel the travel contract without notice if the passenger, if the passenger fails to undertake the trip despite. It is justified if the passenger disrupts or breaches the contract to such a degree that the immediate termination of the contract is justified. If the tour operator cancels the tour, he reserves the right to the full travel price, but he must, however, deduct the value of the saved expenses. The tour guide used by us are expressly authorized to act in our name nad to maintain the interests of SimSalaBim Reisen.

Liability:
The liability for damages other than personal injury (including liability for breach of pre-, beside or post-contractual obligations), is bounded to the tripple-tour price. If the damage to the participant was not caused intentionally or through gross negligence or if the organizer is just responsible fo one service provider. Limitation or liability, government regulations, based on international conventions apply on our service and to our advantage. We are not liable for benefits that are only obtained as foreign and which are marked as in the tender offer other organizers, also we do not participate when the local leisure management arrange these events.

Insurance:
Each participant is responsible for his own personal insurance cover. Recommended insurance are:

• Liability Insurance
  Accident insurance
• Travel insurance
• Baggage Insurance
• Trip cancellation insurance

Traveller responsibilities, termination by the traveler, time-limit:
If defects occur you are obliged to immediately report to the local tour guide and to demand redress. Your claims are only valid if you innocently omitted obligations to complain. If the tour is due to a deficiency significantly affected, you can cancel the travel agreement. The same applies if the travel can not be done as a result of such a lack of important which is reasonable and recognizable for us. The termination is only permissible if we or our local tour guides have passed the reasonable deadline without offering help. The provision of a period is not required if the remedy is impossible or is refused by us or our guides or immediate termination. This happens by a special interest of your which does not belong to the services. All claims that are related to the travel contract, for whatever legal reason, you must claim within one month after the scheduled end of the travel. This assertion against us can only take place in that period  and only to the mentioned address. A written form is recommended. Claims against SimSalaBim Reisen, for whatever legal reason - with the exception of the tort claims statute of limitations - are only valid for one year after the contractually planned return date. Excluded is an assignment of a passenger's rights to third parties. Similarly, the judicial enforcement of claims by third parties in their own name is invalid.

Other provisions:
The traveler can sue the tour operator only at its residence. In proceedings of the operator against the traveler the residence of the traveler, is essential, unless the action is directed against entrepreneurs, political parties or persons who have no general jurisdiction in Germany or have moved abroad or whose habitual residence at the time of legal action is unknown. In these cases the residence of the organizer shall prevail. Our offer and one of our Internet existence of a future contract of any kind are subject, in all its legal effects, particularly with regard to its genesis, processing and ensuring only the right of the BRD.
